Abstract
En la presente tesis se analiza la configuración del ciberacoso laboral, se
identifica la relación y diferencia que tiene esta conducta frente a otros riesgos
de carácter psicosocial. Asimismo, se explican las causas y efectos del
ciberacoso laboral sobre las relaciones laborales, así como la importancia que
adquiere su prevención en el contexto del teletrabajo. También se analiza la
prevención del ciberacoso laboral en el marco normativo de la organización
internacional de trabajo (OIT) específicamente en el Convenio No. 190 sobre
violencia y acoso, así como en el derecho comparado de España, Uruguay y
Argentina. A partir de ello, siguiendo un enfoque de carácter transversal, se
analiza la prevención del ciberacoso laboral en el marco normativo peruano,
específicamente en legislación sobre seguridad y salud en el trabajo, salud
mental y teletrabajo. De este modo, aplicando el método dogmático se concluye
que el marco normativo peruano regula la prevención del ciberacoso laboral en
el contexto del teletrabajo; sin embargo, se advierte la posibilidad de garantizar
un mayor nivel prevención del ciberacoso en el teletrabajo para lo cual, se
formulan dos (02) propuestas: i) La modificación parcial de la legislación laboral
vigente y ii) La regulación de la prevención del ciberacoso laboral en el
teletrabajo mediante convenios colectivos o normas organizacionales.
In this thesis we analyze the configuration of cyberbullying at work, we identify the relationship and difference that this behavior has compared to other risks of a psychosocial nature. Likewise, we explain the causes and effects of workplace cyberbullying on labor relations, as well as the importance of its prevention in the context of teleworking. In addition, we analyze the prevention of workplace cyberbullying in the laws of the international labor organization (ILO) specifically in Convention No. 190 on violence and harassment, as well as in the comparative law of Spain, Uruguay and Argentina. Based on this, following a transversal approach, we analyze the prevention of cyberbullying in the workplace in Peruvian laws, specifically in legislation on occupational safety and health, mental health and teleworking. Therefore, applying the dogmatic method we conclude that Peruvian laws regulate the prevention of cyberbullying in the workplace in the context of teleworking; however, we warn of the possibility of guaranteeing a higher level of prevention of cyberbullying in teleworking. For which, we formulate two (02) proposals: i) The partial modification of current Peruvian laws and ii) The regulation of the prevention of cyberbullying at work in teleworking through agreements collective or organizational norms.
