Los planes y convenios de formalización – Instrumentos para fomentar la formalidad laboral en las microempresas: enfoque legal de formalización laboral

Resumen
La gran problemática que afecta, concierne y determina el desarrollo económico de
nuestro país es la informalidad laboral, que se genera con mayor frecuencia en las
microempresas, asimismo, son los empleadores quienes contribuyen al crecimiento de
la informalidad, puesto que disfrazan las vulneraciones a los derechos de los
trabajadores y además superponen los costes laborales de su empresa en esta relación
de agentes del mercado. El objetivo del presente trabajo se centra en determinar el
enfoque legal estratégico de los Planes de Formalización preferentemente destinados a
las microempresas, regulado en el artículo 18.6 del Reglamento de la Ley General de
Inspección del Trabajo, para luego analizar el Decreto Supremo que propone la
modificación de los Planes de Formalización; debido a ello, es necesario verificar los
instrumentos legales a fin de brindar un aporte al conocimiento jurídico en el que se
emplee las fuentes del derecho del trabajo en aras de ofrecer un medio idóneo a nivel
legal que favorezca y sobre todo coadyuve a hallar la dirección para el fomento de la
formalidad laboral en las microempresas, ya que, en la actualidad, los Planes de
Formalización se encuentran plasmados como una medida inspectiva. Así, concluimos
que, los Planes de Formalización deben de ser implementados y aplicados de manera
ex ante y ex post, a fin de reconocer la importancia de la naturaleza de la formalización
laboral desde la Ley MYPE, debido a que es una condición necesaria para el respeto
de los derechos laborales y la dignidad de la persona.
The great problem that affects, concerns and determines the economic development of our country is labor informality, which is generated more frequently in micro-enterprises, in the same way, it is employers who contribute to the growth of informality, since they disguise the violations of the workers' rights and also superimpose the labor costs of your company in this relationship of market agents. The objective of this work is focused on determining the strategic legal approach of the Formalization Plans preferably aimed at micro-enterprises, regulated in article 18.6 of the Regulations of the General Labor Inspection Law, to then analyze the Supreme Decree that proposes the modification of the Formalization Plans; Due to this, it is necessary to verify the legal instruments in order to provide a contribution to the legal knowledge in which the sources of labor law are used in order to offer an ideal means at the legal level that favors and specially helps to find the direction for the promotion of labor formality in micro-enterprises, since, at present, the Formalization Plans are embodied as an inspection measure. In this way, we conclude that the Formalization Plans must be implemented and applied ex ante and ex post, in order to recognize the importance of the nature of labor formalization from the MYPE Law, because it is a necessary condition for the respect for labor rights and the dignity of the person.
