Resumen
El actual informe jurídico analiza la resolución No. 03640-2021-PHC/TC, en
relación con la demanda de inconstitucionalidad presentada por Piero Renzo
Dellepiane Reggiardo en su propio nombre, en el de sus familiares y en el de los
propietarios de los condominios "Terrazas de Chepeconde S.A.C." e
"Inversiones Condominio Aventura S.A.C." contra el "Club Tennis Las Terrazas
Miraflores" (en adelante "Club Terrazas") por vulneración del derecho
constitucional a la libre circulación.
Esta situación surge a partir de la implementación por parte del Club Terrazas
de un sistema de portón, control y vigilancia en el kilómetro 120,8 de la
Panamericana Sur, que restringe el acceso a las playas de Cerro Azul que
colindan con su predio, a pesar de que existe una servidumbre de paso (en
adelante, SP) y una Resolución Jefatural mediante la cual, la municipalidad la
reconoció como un acceso de uso público de conformidad con la normativa
especial.
Al respecto, el Tribunal Constitucional (en adelante, el TC) La demanda fue
estimada parcialmente, condenando al Club Terrazas a garantizar el libre acceso
a las playas y reconociendo la vulneración del derecho al libre tránsito. Coincido
con esta postura y la utilizaré para ilustrar la importancia de garantizar vías de
acceso que permitan a los ciudadanos acceder a espacios públicos, como las
playas.
Para ello, en primer lugar, Dilucidaré el régimen de playas para determinar el
marco normativo que se aplicará al caso concreto, evaluaré la existencia de una
vía de acceso en el km 120,8 de la Carretera Panamericana Sur y desarrollaré
el concepto del derecho constitucional a la libertad de tránsito. Con base en ello,
determinaré si se vulneró el derecho a la libertad de tránsito del demandante.
En segundo lugar, evaluará si la presencia de un SP es una condición necesaria
para garantizar el libre acceso a la playa. En tercer lugar, se estudiará el
mecanismo de habeas corpus (en adelante HC) para determinar si es el método
adecuado para garantizar el derecho a la libertad de tránsito.
Finalmente, El derecho constitucional del demandante a la libertad de tránsito
fue violado, como se determinó en el análisis antes mencionado. Además, se
determinará que no es necesaria la presencia de un SP para garantizar el acceso
sin restricciones a las playas. En consecuencia, la HC es el recurso de protección
adecuado en caso de que se acredite la violación del derecho a la libertad de
tránsito, y no sirve como método de ejecución de resoluciones administrativas.

The Constitutional Court declared the claim founded for proving the violation of the right to free movement and ordered the “Club Tennis Las Terrazas Miraflores” to guarantee free access to the beaches, a position that I share and for which I will demonstrate the importance of there being accesses that allow the entry of citizens to public spaces such as beaches. First of all, I am going to explain the beach regime to identify the rules that will apply to this specific case. I will evaluate the existence of an access road at km 120.8 of the South Pan-American Highway and the concept of the constitutional right to freedom of transit will be developed. I will determine whether the plaintiff's right to freedom of movement was violated. Secondly, I will analyze whether the existence of a right of way is an essential requirement to guarantee free access to the beaches. Thirdly, I will develop the concept of the habeas corpus mechanism and, consequently, A determination will be made as to whether habeas corpus is the most effective method of guaranteeing the right to freedom of movement. Finally, the conclusion that the constitutional right to freedom of movement was violated will be reached as a consequence of the previous analysis. Additionally, the presence of a right of way is not a prerequisite for ensuring that the beaches are accessible without charge. As a result, habeas corpus is the appropriate method of safeguarding against the violation of the right to freedom of movement without serving as a means of enforcing administrative resolutions.
