Resumen
La pesca se considera una actividad económica de gran importancia en nuestro
país, ya que contribuye significativamente al desarrollo económico nacional. Los
recursos hidrobiológicos son reconocidos como patrimonio de la nación, y su
gestión sostenible recae en la responsabilidad del Estado, el cual debe garantizar
su manejo integral. No obstante, en los últimos años, hemos sido testigos de un
preocupante incremento de la pesca ilegal y otros delitos relacionados con esta
actividad.
En respuesta a esta problemática, en el año 2018, el Poder Ejecutivo promulgó
el Decreto Legislativo 1393, el cual regula la interdicción de las actividades
ilegales de pesca. Su objetivo fue implementar acciones para combatir la
ilegalidad en el sector pesquero y asegurar el uso sostenible de los recursos.
Este decreto se realizó en el marco de la delegación de facultades otorgada por
el Congreso de la República (en adelante, el Congreso) mediante la ley
autoritativa 30823 al Poder Ejecutivo.
En este contexto, el presente informe tiene como objetivo detallar los alcances
de la sentencia 265/2021 emitida por el Tribunal Constitucional. la cual resuelve
la demanda de inconstitucionalidad presentada contra el Decreto Legislativo
1393. Dicha demanda fue interpuesta por un grupo considerable de pescadores
artesanales, quienes alegaron que dicho decreto vulneraba sus derechos
fundamentales.
The fishery is considered an economic activity of great importance in our country, as it contributes significantly to national economic development. Hydrobiological resources are recognized as patrimony of the nation, and their sustainable management falls under the responsibility of the State, which must guarantee their integral management. However, in recent years, we have witnessed a worrying increase in illegal fisheries and other crimes related to this activity. In response to this problematic, in 2018, the Government promulgated the Legislative Decree 1393, which regulates the interdiction of illegal fishing activities. Its objective was to implement actions to combat illegality in the fishing sector and ensure the sustainable use of resources. This decree was made in the delegation of powers granted by the Congress of the Republic through the authoritative law 30823 to the Government. In this context, the purpose of this report is to detail the implications of sentence 265/2021 emitted by the Constitutional Court, which resolves the unconstitutionality lawsuit filed against Legislative Decree 1393. This lawsuit was filed by a considerable group of artisanal fishermen, who alleged that the decree violated their fundamental rights.
