Resumen
La relevancia del enfoque de género en la valoración probatoria, en el delito de violación sexual para mujeres mayores de 18 años, es el tema central en el presente estudio, destacaremos los aspectos culturales e históricos que han determinado los distintos roles que le han tocado ejercer a la mujer en la sociedad, demostrando la vulnerabilidad de sus derechos cuando le corresponde una posición de víctima.
El principio de igualdad y la no discriminación es el punto de partida que se expresa en el presente análisis, por ello, los órganos que persiguen el delito e imparten justicia deben reconocer patrones culturales que asignan un determinado tipo de rol a la mujer dentro de la sociedad y entiendan la situación de desventaja y vulnerabilidad; sabiéndose la particular influencia formativa basada en prejuicios sesgados reflejándose en el momento de la valoración de medios de prueba y en consecuencia no emitiéndose una decisión justa, recayendo en lo irracional ante sometimientos públicos.
Juzgar bajo la inclusión de género no es otorgar la razón a una mujer por su condición biológica, tampoco los variados desniveles estructurales enmarcados que puedan connotar y ser reflejados en el proceso; lograr una justicia inclusiva de género significa superar sesgos y estereotipos culturales para transformar la realidad y la vida de las personas sobre la base de la igualdad; exigir un derecho no es pedir un favor, es lo que corresponde y en ello este trabajo busca marcar la diferencia entre un antes y un después
The relevance of the gender approach in the evidentiary assessment, in the crime of rape for women over 18 years of age, is the central theme in this study, we will highlight the cultural and historical aspects that have determined the different roles that they have had to exercise to women in society, demonstrating the vulnerability of their rights when a position of victim corresponds to them. The principle of equality and non-discrimination is the starting point that is expressed in this analysis, therefore, the bodies that prosecute crime and impart justice must recognize cultural patterns that assign a certain type of role to women within the society and understand the situation of disadvantage and vulnerability; knowing the particular formative influence based on biased prejudices reflected at the time of the evaluation of means of proof and consequently not issuing a fair decision, falling back on the irrational before public submissions. Judging under the inclusion of gender is not giving reason to a woman because of her biological condition, nor the various framed structural imbalances that may connote and be reflected in the process; achieving inclusive gender justice means overcoming cultural biases and stereotypes to transform reality and people's lives on the basis of equality; demanding a right is not asking for a favor, it is what corresponds and in this this work seeks to make the difference between a before and an after
