Resumen
La presente tesis tiene por título “El beneficio de la prima textil y la problemática respecto
de su ámbito de aplicación” y tuvo como objetivo determinar si este beneficio se encuentra
aún vigente y a quienes se le aplican a la luz de diversas normas que en el tiempo han
regulado este beneficio.
Si bien es cierto, a la fecha de la presente investigación, existen sentencias con criterio
jurisprudencial de obligatorio cumplimiento emitidas por la corte Suprema, existe aún
algunas reflexiones que no han sido ventiladas y que hemos referido en la presente
investigación respecto a la regulación de la prima textil.
Según lo expuesto por Roberto Hernández Sampieri (2014), esta investigación tiene un
enfoque cualitativo ya que los planteamientos en esta investigación se fueron dando a
medida que aquella se ha ido desarrollado. No se utilizó la estadística para hacer las
generalizaciones como se hace en el enfoque cuantitativo.
El tipo de esta investigación corresponde a la de un “estudio de caso”. Por ser cualitativo,
en esta investigación no se planteó ninguna hipótesis, siendo que, luego del análisis
correspondiente, se llegó a la conclusión principal que la prima textil fue un beneficio
otorgado para el obrero textil y que hasta la fecha sigue vigente, siendo que sus rastros
históricos lo encontramos a nivel convencional en el año de 1919 y que luego se convierte
en norma legal de carácter general mediante Decreto Supremo del 10 de julio de 1944.
Sin embargo, a la luz del Decreto Supremo Nº 011-2012-TR, se observa cierta restricción
del ámbito objetivo de quienes deben efectuar el pago de la prima textil, situación que
deberá esclarecerse.
The present investigation is entitled “The benefit of “prima textile” and the problems regarding its scope of application” and it aims to determine if this benefit is still available and to whom it is applied, taking into account various regulations that over time, have regulated this benefit. Although it is true, as of the date of this investigation, there are binding judicial sentences, which are also called mandatory jurisprudence issued by the Supreme Court; there are still some reflections that have not been aired and that we have rescued in this investigation regarding the regulation of prima textile As stated by Roberto Hernández Sampieri (2014), this research has a qualitative approach, since the approaches in this research were given as the research was developed, statistics were not used to make generalizations as it is done in the quantitative approach. The type of this research corresponds to that of a “case study”. Since the investigation is qualitative, no hypothesis was raised, and after a detailed analysis of the case study, the main was reached: Prima textile was a benefit granted to the textile labourer and it is still valid as to this day, we find it historical traces ,at the conventional level, in the year 1919 and it later acquires a normative character by Supreme Decree stated on July 10, 1944, nonetheless, there are still situations that should be clarified.
