Abstract
El presente informe tiene como finalidad resolver los principales problemas
jurídicos generados a partir de la Casación Laboral N.° 26374-2019-Arequipa en
el que se desarrolla el caso de un trabajador que fue despedido por asistir a su
centro de trabajo en estado de embriaguez conforme al literal e) del artículo 25
del Texto Único Ordenado de la Ley de Productividad y Competitividad Laboral.
Al respecto, determinaremos si la falta grave por asistir al centro de trabajo en
estado de embriaguez responde a una tolerancia cero de alcohol. Para ello,
evaluaremos la relevancia del nivel de alcohol en la sangre de un trabajador que
asiste a laborar en estado de embriaguez, la posibilidad de traslado de
parámetros penales y/o administrativos al ámbito laboral para determinar si el
trabajador se encuentra en estado de embriaguez y la relevancia de las
funciones realizadas por el trabajador a efectos de aplicar el despido.
A partir de tal análisis, concluimos que para sancionar a un trabajador por asistir
al centro de trabajo en estado de embriaguez, es necesario comprender el
significado de la misma y contar con parámetros objetivos que permitan
demostrar si el trabajador se encontraba en tal estado. Por tanto, a diferencia de
lo resuelto por la Corte Suprema, no se debió aplicar el despido como medida
disciplinaria al trabajador.
The purpose of this investigation is solve the legal problems generated because of the Casación Laboral N.° 26374-2019-Arequipa. The judgment develops the case of a employee that was dismissal for attending to work drunkenness according to the subsection e) of article 25 of the Texto Único Ordenado de la Ley de Productividad y Competitividad Laboral. In that way, this investigation will determine if the serious misconduct of attending to work drunkenness means cero alcohol in the organism of the employee. In order to solve that problem, it is necessary to evaluate the relevance of the quantity of alcohol that an employee presents, the possibility of translation of the civil and/or criminal parameters to conclude if the employee is drunkenness and the relevance of the labors for applying the dismissal. As a result of the analysis, to apply a disciplinary action that sanctions an employee for attending drunkenness at work, it is necessary to understand the meaning of drunkenness and have objective parameters that demonstrate if the employee is in that state of drunk. On the whole, unlike what was decided by the Supreme Court, the dismissal should not have been applied as a disciplinary measure to the employee.
