¡Señor Registrador, quiero sanear mi predio! La renuncia al derecho de propiedad predial, a propósito del CIX Pleno del Tribunal Registral

Resumen
Desde una perspectiva crítica, en el presente artículo se pretende reflexionar
acerca de los alcances y efectos del primer precedente de observancia
obligatoria, aprobada en el CIX Pleno del Tribunal Registral, mediante
Resolución N° 240-2013-SUNARP/PT, publicada en el diario oficial El Peruano
el 13 de setiembre de 2013, el cual dispone que “es inscribible la cancelación de
la inscripción del derecho de propiedad sobre todo el predio y su consiguiente
desinmatriculación por renuncia de su titular, siempre que ello no afecte derecho
de terceros.”
Es fundamental reflexionar acerca de la importancia de contar con precedentes
de observancia obligatoria acordes al derecho actual, no solo para resolver
cuestiones prácticas, sino también para contribuir a la mejora del sistema
registral. A criterio del autor, el referido precedente de observancia obligatoria
resulta impreciso en su contenido, lo que ocasiona que el sistema registral en el
Perú sea incierto e impredecible.
El autor sugiere su modificación, resaltando la importancia de que el Tribunal
Registral revise nuevamente el criterio admitido en el referido precedente de
observancia obligatoria, limitando su aplicación solamente para los casos en los
cuales se pretenda el saneamiento del predio a nivel registral por temas de
duplicidad de partidas, superposición y rectificación de área.
From a critical perspective, this article aims to reflect on the scope and effects of the first binding precedent, approved in the CIX Plenary of the Registry Court, through Resolution No. 240-2013-SUNARP/PT, published in the official newspaper El Peruano on September 13, 2013. This resolution states that "the cancellation of the registration of the property right over the entire property and its consequent withdrawal from the registry due to the owner's resignation is registrable, provided that it does not affect the rights of third parties." It is essential to contemplate the importance of having binding precedents in line with current law, not only to address practical issues but also to contribute to the improvement of the registry system. In the author's opinion, the mentioned binding precedent is imprecise in its content, causing the registry system in Peru to be uncertain and unpredictable. The author suggests its modification, emphasizing the importance of the Registry Court reviewing the criteria accepted in the aforementioned binding precedent. The author proposes limiting its application only to cases where the regularization of the property at the registry level is sought due to issues such as duplicate entries, overlap, and area correction.
