Desde los albores del siglo diecinueve, la jurisprudencia norteamericana ha reconoci-do que los estados soberanos pueden gozar de immunidad jurisdiccional en las cortes de los Estados Unidos. En 1976, el Congreso norteamericano aprobó la Ley de Inmunidades de Soberanos Extranjeros (Foreign Sovereign Immunities Act-FSIA) que desde enton-ces se ha constituído en la principal base normativa para someter a la jurisdicción de cortes estadounidenses a estados soberanos o a sus entidades.
