La inmunidad del Estado extranjero ante los tribunales del Estado del foro es un concepto que la doctrina internacional ha discutido por mucho tiempo. La inmunidad estatal deriva del principio de la igualdad soberana de los Estados que es a su vez uno de los principios fundamentales del orden jurídico internacional. Este principio debe ser visto junto con aquel que establece que cada Estado posee soberanía sobre su territorio derivándose de ello su jurisdicción sobre los hechos y personas dentro de dicho territorio.
