La ‘huida’ a los NFT: Sobre los ‘límites prácticos’ de la protección de los Derechos de autor del ordenamiento peruano en el caso de las obras pictóricas digitales

Abstract

El régimen de protección de derechos de autor peruano se adjunta a un sistema cerrado de limitaciones y excepciones. Sin embargo, la rigurosidad de este presenta “límites prácticos” en su aplicación, los cuales afectan negativamente a los creadores de obras pictóricas. En ese sentido, se reflexionará en torno a si efectivamente se permite la realización de la finalidad de la institución de los derechos de autor. Asimismo, ante la creciente popularidad de la actividad comercial de obras pictóricas digitales a través de tokens no fungibles (conocidos como NFT por sus siglas en inglés), resulta menester reflexionar sobre la razón de la ‘huida’ desde la comercialización tradicional del arte pictórico digital hacia esta nueva alternativa para hacer frente a la alta difusión y reproducción de sus obras en la red. Así, se demostrará la poca efectividad de la protección e incentivo del ordenamiento hacia la libertad creativa, intelectual y artística.

The Peruvian Copyright protection regime is attached to a closed system of limitations and exceptions. However, this rigor presents “practical limits” in its application, which do not allow the realization of the purpose of this institution. It will be analyzed how these “practical limits” are presented in the dynamics through the Internet in the case of digital pictorial works. Likewise, we will demonstrate how the rise of transactions through “non-fungible tokens” (NFT) have represented an alternative route to traditional marketing for artist authors in the face of the high diffusion and reproduction of their works on the network. These NFT transactions will demonstrate the ineffectiveness of the traditional protection and incentive of the legal system towards creative, intellectual, and artistic freedom.
