Informe Jurídico sobre resolución de Consulta correspondiente al Expediente N°10978 – 2020 LAMBAYEQUE

Abstract

El presente trabajo pretende determinar si estamos de acuerdo con el decisorio de la Corte Suprema al aprobar la consulta respecto a la resolución correspondiente al Expediente N°10978 – 2020. Para lo cual, analizaremos el criterio adoptado por el órgano jurisdiccional de segunda instancia, luego estableceremos los criterios de aplicación de control difuso, y finalmente, analizaremos el criterio interpretativo y argumentativo de la Corte Suprema respecto a la aplicación del control difuso acorde a los criterios establecidos en el Primer Pleno Jurisdiccional en materias Constitucionales y Contenciosas Administrativo.

The purpose of this paper is to determine whether we agree with the decision of the Supreme Court in approving the consultation regarding the resolution corresponding to Case No. 10978 - 2020. For which, we will analyze the criteria adopted by the second instance jurisdictional body, then we will establish the criteria for the application of diffuse control, and finally, we will analyze the interpretative and argumentative criteria of the Supreme Court regarding the application of diffuse control according to the criteria established in the First Jurisdictional Plenary in Constitutional and Contentious-Administrative matters.
