La Fiscalización frente Actos Discriminatorios

Abstract

Por medio del presente documento hemos tratado dilucidar todas las formas en que el ordenamiento jurídico protege el derecho a no ser discriminado. Este análisis no solo comprende a la regulación, sino a la ejecución de medidas preventivas y reactivas cuyo objetivo sea el reprimir este tipo de conductas. En ese sentido, consideramos pertinente desarrollar el concepto constitucional del derecho a la no discriminación, la asignación de funciones de distintas instituciones del Estado, en el marco de la lucha contra la discriminación, así como la forma en que se ejecutan las acciones. Por otro lado, luego de revisar opiniones de juristas especializados en la materia, el marco legal aplicable y los pronunciamientos de las distintas entidades que imparten justicia en nuestro país, nos permitimos llegar a conclusiones que no solo ponen en evidencia los distintos vacíos que podría tener la norma frente a la realidad, sino que, además, se podrá observar los distintos puntos de mejora que pueden trabajarse, a efectos de lograr una lucha más eficiente contra la discriminación.

Through this document we have tried to elucidate all the ways in which the legal system protects the right not to be discriminated against. This analysis not only includes regulation, but also the execution of preventive and reactive measures whose objective is to repress this type of behavior. In this sense, we consider it pertinent to develop the constitutional concept of the right to non-discrimination, the assignment of functions of the different State institutions, within the framework of the fight against discrimination, as well as the way in which actions are carried out. On the other hand, after reviewing opinions of jurists specialized in the matter, the applicable legal framework and the pronouncements of the different entities that administer justice in our country, we allow ourselves to reach conclusions that not only highlight the different gaps that could have the norm in front of the reality, but, in addition, it will be possible to observe the different points of improvement that can be worked on, in order to achieve a more efficient fight against discrimination.
