¿Se puede emplazar la demanda vía aplicativo Whatsapp o correo electrónico?. Breve ensayo sobre el derecho de defensa y de notificación de las Resoluciones Judiciales en el Proceso Civil Peruano

Abstract

A través de este trabajo de investigación, el autor analizará las garantías procesales peruanas y españolas que involucran el acto de emplazar la demanda al domicilio legal del demandado. Para ello, se explicarán las razones por las que no resulta válido emplazar al demandado mediante aplicativo WhatsApp y/o un correo electrónico. Para estos efectos, se analizará las garantías que involucran el acto de emplazar la demanda, las cuales van más allá de la garantía de que el demandado tome conocimiento.

In this paper, the author analyzes the Peruvian and Spain procedural guarantees that involve the act of serving the lawsuit at the defendant’s legal domicile. It explains the reasons why the defendant cannot be summoned to the WhatsApp application or to an-email. For the purposes, the guarantees that involve the act of serving the claim at the defendant will be analyzed, which go beyond the guaranteeing that the defendant becomes aware of the claim.
