Resumen
En el año 2009, el Tribunal Constitucional declaró improcedente la demanda de amparo
interpuesta por AIDESEP contra el Ministerio de Energía de Minas, Perupetro, Barret
Resource Perú Corporation y Repsol YPF, al indicar que no se había demostrado la
presencia de pueblos indígenas en aislamiento voluntario y contacto inicial en la zona que
abarcaban los lotes 39 y 67, contratos de licencia de exploración y explotación,
respectivamente, celebrados con el Estado vía decretos supremos y la no suspensión de
estas actividades.
Dicha decisión conlleva a la vulneración del derecho al territorio de los pueblos indígenas
en la zona, desencadenándose mayores afectaciones a sus derechos, puesto que las
actividades a realizarse implican el ingreso de terceros a la zona que habitan, exponiendo
a los PIACI a su consecuente muerte por los conflictos que se desarrollan, así como la
exposición a enfermedades.
Frente a ello, el presente informe jurídico aborda la problemática de la vulneración al
derecho al territorio de los pueblos indígenas en aislamiento y en contacto inicial, ante la
primacía de la explotación de recursos naturales por sobre derechos humanos en
cumplimiento de lo dispuesto por el marco jurídico peruano y diversos tratados a los que
el Perú está adscrito sobre pueblos indígenas.
