¿Justos pagan por pecadores? Analizando las modificaciones a las reglas del arbitraje contra el Estado peruano

Abstract

In recent years, there have been many cases of corruption in arbitrations with the Peruvian state. As a result of them, the country has been forced to pay millionaire sums. In order to solve these problems, the Peruvian government issued Emergency Decree 020-2020, which modified the Legislative Decree 1071, Legislative Decree that regulates arbitration, in relation to arbitrations with the State.In this article, the author explains the reasons why these modifications have not been effective to solve the real problem for which Decree was published: avoid corruption in arbitration with the Peruvian State.

En los últimos años se han visto muchos casos de corrupción en los arbitrajes con el Estado peruano, a raíz de los cuales el país se ha visto obligado a pagar millonarias sumas. Con motivo de solucionar dichas prácticas, el gobierno peruano emitió el Decreto de Urgencia 020-2020, el cual modificó el Decreto Legislativo 1071, Decreto Legislativo que norma el arbitraje, en lo relacionado a los arbitrajes con el Estado.En el presente artículo, el autor aborda las razones por las cuáles dichas modificaciones no han resultado efectivas para combatir la verdadera razón por la cual se publicaron: evitar la corrupción en los arbitrajes con el Estado peruano.
