El intento de las víctimas y sus familias por acceder a la justicia.Trata de personas, violencia y explotación: 40 testimonios

Abstract

La presente investigación cualitativa, describe a través de entrevistas a profundidad las vivencias de 30 víctimas de trata de personas y 10 de sus familiares, en su interrelación con diversos sistemas del Estado, después de salir de la situación de trata de personas. Se recoge su percepción sobre la interacción con los representantes de los sistemas de justicia y de servicios, a cargo de facilitarles el acceso a la justicia y la atención en condiciones adecuadas, para su recuperación y reintegración. La investigación se ciñó a estrictos procedimientos y estándares éticos, cuidando la calidad del vínculo, la reserva y tratamiento de la información y la rigurosidad y privacidad del registro de los testimonios. Los antecedentes del perfil de las víctimas entrevistadas dan cuenta de la diversidad de las zonas y los tipos de captación y explotación, y de las diferentes modalidades en las que se articula la violencia que vivieron las víctimas y sus familias. Con la finalidad de comprender las características de la interrelación autoridadvíctima- familia, se describen brevemente los tipos penales relevantes, así como los deberes y obligaciones que prescriben los manuales y protocolos del Estado a sus funcionarios. Algunos conceptos relevantes y pertinentes para el análisis de la información recopilada se han también desarrollado sucintamente como el impacto de la estigmatización y la re victimización, el rol y la complejidad de las violencias entrecruzadas que acompañan los escenarios vivenciales de las víctimas y sus familias, así como la manera en que la indefensión adquirida y la intensidad del trauma se presentan antes, durante y después de la explotación. Los hallazgos permiten repensar algunos procedimientos y políticas públicas con relación al acceso a la justicia y a la reintegración de los sobrevivientes, que se plantean en la discusión de los capítulos. También se destaca, entre otros, la importancia de incorporar siempre la perspectiva de género, y los enfoques centrado en la víctima y en el trauma. La voz y experiencias de las víctimas y de las familias, son contundentes y conducen a plantear modificaciones para acercar una justicia real y efectiva a los afectados por la trata de personas en el Perú.

Through in-depth interviews, this qualitative study describes the experience of 30 victims of trafficking in persons and ten of their relatives, in their interrelations with different public institutions and systems of the State, after having left the trafficking context. We gather their perceptions regarding the interaction with representatives of the justice and social services and systems, responsible with facilitating their access to justice and care under adequate conditions to allow their recovery and reintegration into society. The research followed strict procedures and ethical standards, to assure safe and respectful interaction with the participants, adequate treatment of classified information, as well as privacy and rigor while recording the testimonies. The different backgrounds and profiles of the victims interviewed reflect the diversity of geographical zones and types of recruitment and exploitation, and how these are related to the different manners of violence experienced by the victims and their families. In order to clarify the characteristics of the authority-victim-family interrelation, we briefly describe the relevant criminal offenses, as well as the duties and obligations prescribed through the State’s manuals and protocols to its public servants. We also briefly develop some pertinent concepts, necessary for an analysis of the collected information, such as the impact of stigmatization, the repeated victimization, the role and complexity of cross-violence that is part of the life of victims and their families. Acquired helplessness and the intensity of trauma before, during and after exploitation process are also taken into account. The findings allow rethinking some of the procedures and public policies regarding access of justice and reintegration of survivors, as they appear in the discussion throughout the chapters. They also highlight, among others, the utmost importance to always incorporate a gender perspective, as well as a victim and trauma centered approach. The voice and experiences of the victims and their families are conclusive and overwhelming. They urge us to propose changes to obtain real and effective justice for victims of trafficking in persons in Peru.
