La decisión andina 876 - régimen común de marca país, norma pionera y vanguardista, que tendrá un impacto multilateral

Abstract

The country Brand is a sign that many countries have today, however, it does not have recognition and protection at the multilateral level from the existing rules of Industrial Property, given this need the block of countries that make up the Andean Community, after several years of negotiation, has managed to approve the Andean Decision 876 on the Common Country Brand Regime, without a doubt this is a pioneering an highly avant-garde standard, which will have a multilateral impact in the coming years.This article analyzes the existing problems for the protection of a country brand, evidencing the need to have a specific regulation that recognizes and protects this sign, it also analyzes and comments on the most relevant aspects of the regulation contained in Andean Decision 876 and finally, it indicates what is the pending task in this matter, detailing the most important advances that have been made to date for the recognition and protection of the country brand before the World Intellectual Property Organization (WIPO), the highest international authority on the matter.

La marca país, es un signo con el que cuentan muchos países hoy en día, sin embargo, no tiene un reconocimiento y protección a nivel multilateral desde las normas existentes de la Propiedad Industrial, ante esta necesidad el bloque de países que conforman la Comunidad Andina, tras varios años de negociación, ha logrado aprobar la Decisión Andina 876 sobre el Régimen Común de Marca País, sin duda esta es una norma pionera y sumamente vanguardista, que tendrá un impacto multilateral en los próximos años.El presente artículo analiza la problemática existente para la protección de una marca país, evidenciándose la necesidad de contar con una regulación específica que reconozca y proteja a este signo, también analiza y comenta los aspectos más relevantes de la regulación que contiene la Decisión Andina 876 y finalmente señala cual es la tarea pendiente en este tema, detallando los avances más importantes que han habido hasta la fecha para el reconocimiento y protección de la marca país ante la Organización Mundial de la Propiedad Intelectual (OMPI), la máxima autoridad internacional de la materia.
