Item Metadata only Voces en el silencio(Pontificia Universidad Católica del Perú, 2023-11-13) Ormeño Castro, Javier AlfonsoThis paper explores the effects of hospitality rites and the co-creation of common spaces as a means to achieve transitional justice in Peru, 20 years after the 1980–2000 internal armed conflict. It describes a tea ceremony in La Hoyada, a place used by the Army as a clandestine burial ground. A foreign act of hospitality breaks the temporality of the site; mindful actions create silence, and the voices of people are better heard. This work describes the development of an incipient methodology, an intimate language of presence, and how video recordings of participants’ testimonies captured the feelings arising in a one-time silent event.Item Metadata only El paradigma constitucional del proceso civil. Bases teóricas(Pontificia Universidad Católica del Perú, 2024-09-05) Delgado Suárez, ChristianThis essay offers a feasible and verifiable theoretical basis for affirming what is called the fourth procedural paradigm, corresponding to the constitutional perspective of the civil procedure or the constitutionalization of it, as an overcoming of its previous classical and instrumentalist stages. To this end, through the interdisciplinary method, the research uses constitutional law, legal interpretation and procedural law to reshape the theoretical bases of the civil process and give it a constitutionalized value through the recognition of fundamental procedural rights as directly applicable norms containing optimization mandates. If it is a question of constitutionalizing the civil procedure, the essay, then, does not only seek the safe passage through the account of the so-called procedural guarantees. On the contrary, the functional or utility method applied to the same imposes that the contribution is to recognize the judge of the Constitutional State the duty of judicial protection even of the same fundamental procedural rights in the face of the defect or absence of rules that should implement and densify the principle of effective jurisdictional protection. This will make it possible to deconstruct and reconstruct concepts such as the fundamental right to effective judicial protection and the right of action, removing from them the slogan of mere guarantees that allow access to jurisdiction, to give them the character of optimization mandates directly executed by judges. It is, then, about the protection of the procedure, within the procedure, by the judge.Item Metadata only Legitimación en la ejecución, título ejecutivo y escisión societaria: una crítica a la “teoría de la afirmación”(Pontificia Universidad Católica del Perú, 2024-09-05) Valenzuela, Gabriella; Cavani, RenzoThis article aims to criticize the so-called “assertion theory” of civil procedure standing to sue, accepted by a significant part of the Peruvian jurisprudence, and consecrated by the Peruvian Civil Procedure Code. The paper seeks to show that this theory should be discarded since it has several conceptual problems, furthermore, it is not capable of giving an account of actual judicial practice when analyzing and deciding on the presence or absence of standing to sue. This becomes more noticeable in the field of judicial enforcement, and, to that extent, an example of corporate spin-off will be given to show that proving the existence of standing to sue concerning enforcement title can be complex, but that is essential for the judge to carry out this analysis.Item Metadata only Prueba informática: el problema de su fiabilidad(Pontificia Universidad Católica del Perú, 2024-09-05) Alfaro Valverde, LuisThe data contained in computer and technological devices are increasingly used as evidence in judicial processes, being decisive in the final decisions of judges. This is the so-called computer test. These are often valued uncritically as mere documentary evidence, without considering, among other things, their vulnerable and complex nature. Among the different problems that exist about this test, this study focuses specifically on those related to its reliability. Firstly, the aspects related to the nature of the computer test are examined, as well as its rational assessment. Then, the central question of its reliability is reviewed, related to the risk of its manipulation and its impact on it. Finally, some instruments are analyzed that allow their reliability to be adequately managed, such as expertise, the electronic signature and the intermediation of the notary in the certification of digital evidence.Item Metadata only Causalidad e imputación en la responsabilidad civil médica por infracción al deber de información en intervenciones médicas riesgosas(Pontificia Universidad Católica del Perú, 2024-09-06) Ugarte Mostajo, DanielThis paper addresses the problem of determining causation between a doctor’s breach of his duty to inform and injuries suffered by the patient as a consequence of the occurrence of uninformed risks. The paper criticizes the application of “hypothetical causality” as an explanatory figure for the causal link and also criticizes the idea of ‘hypothetical informed consent’ as a mechanism to exempt the liability of the defaulting doctor. Finally, the paper argues that the real problem in such case scenarios is not strictly a causation one, yet it has a normative and prudential nature. Accordingly, the solution does not require to establish a patient’s supposed a consent, but to correctly apply objective and subjective attribution criteria.Item Metadata only Estrategias para el control del dengue en las áreas urbanas de Lima: un estudio de incidencia en Lima Sur y Lima Norte(Pontificia Universidad Católica del Perú, 2024-09-06) Bocanegra Morales, Cristian Omar; Flores Coapaza, Paul AlexandroThe article examines the issue of dengue within the Peruvian context, with a particular focus on the urban areas of Lima Sur and Lima Norte, regions notable for their high incidence of cases and their significance in the country’s epidemiological landscape. The research employs a mixed methodology, combining quantitative analysis of epidemiological data with qualitative perspectives derived from public health studies. The results reveal a high incidence of dengue in these areas, highlighting the urgent need for more effective measures to control its spread. The study utilizes quantitative data on dengue incidence and prevalence, obtained from health records and epidemiological reports, and conducts a qualitative analysis to identify the environmental, socioeconomic, and health-related factors contributing to the disease’s spread. Factors such as limited access to basic services and environmental conditions conducive to mosquito vector proliferation are emphasized.Additionally, the article proposes the implementation of advanced technologies, such as chatbots, through a strategic approach based on the theory of change. This approach aims not only to mitigate the spread of dengue through early diagnosis and community education but also to improve the quality of life for affected communities. The integration of these technologies is intended to optimize the health system’s response, reduce the burden on traditional medical services, and promote a more effective and sustainable management of the disease.Item Metadata only La moda étnica: su problemática en torno a la apropiación cultural en el Perú(Pontificia Universidad Católica del Perú, 2023-10-21) Amoretti Lamadrid, Elsa MariaEthnic fashion can be problematic due to the very fine line that exists between the inspiration that can be used in the creation of designs and cultural appropriation. There are innumerable cases in which big brands, usually international, use typical designs of a culture belonging to a minority without any type of authorization from these people. This non-consensual use comes to generate harm to the member of these communities, both economically and socially, which is why some countries, in order to reduce these damages, have regulated this issue. Thus, this research seeks to develop key subjects such as ethnic fashion and cultural appropriation, as well as to analyze the current Peruvian situation regarding cultural appropriation.Item Metadata only Planificación Participativa para la reducción del riesgo de desastres: rutas de aprendizaje para reducir la brecha entre estado y territorio(Pontificia Universidad Católica del Perú, 2024-09-13) Recharte, Jorge; Rondán Ramírez, VidalThis case study discusses a problem identified in the global literature: the difficulty of national states in translating their policy instruments for disaster risk reduction and climate change adaptation into effective actions at the local territorial level. We review two perspectives on the territory and modes of intervention: (i) those of government agencies within the Huascarán Biosphere Reserve in Áncash and (ii) those deployed by local organizations in the context of a disaster risk reduction project. The case study presents evidence on the potential of participatory approaches to generate information that can help identify strategies that align adaptation and risk reduction actions to local well-being objectives and productive systems. It is concluded that there is a need to develop collaborative learning spaces between state agencies and communities to improve the effectiveness of policy instruments for disaster risk reduction.Item Metadata only El turismo en el Perú: Historia, cadena y problemáticas(Pontificia Universidad Católica del Perú, 2024-08-15) Armas Asín, FernandoThe text develops, within the framework of the construction of tourist activity, how it was organized and the role that the entities involved had, reviewing the literature on the matter. It is concluded that tourism as an economic sector was built from various global and local events that affected demand and supply, highlighting the nature of the business chain formed. This text also addresses and delimits problems that have affected tourist activity in the past and affect it still. The study can help to better understand this economy and social activity today.Item Metadata only Momentos del Perú en guerra: Testimonio de una vida dedicada a retratar la realidad, pese a sus severas limitaciones(Pontificia Universidad Católica del Perú, 2024-08-15) Jiménez, ErnestoTalking about internal war in Peru is doubly difficult. Because of the issue of political violence that we had to live with and our role as journalists in tow, away from the passions and standard bearers of the famous objectivity whose meaning hammered us every time we took the camera to record what happened. Then came the self-censorship that took us away from the flags that the participants brought as pretexts for the violence unleashed or to unleash. We were interested in the roots of this violence, its origins and the “why” in each case. Thus, we began to see what others did not see: the significance of our documents for history, for its reconstruction. Reviewing my experience of those years (half a century of journalistic work) I have managed to synthesize some objective, transcendental and valid criteria to contribute to history. My search spanned 14 years of conflict. From 1978 (the beginnings of land grabs) until 1992, when they captured the insurgent leaders of the Shining Path. Of course, there are thousands of unpublished images left in the archives. But the demands of the present testimony force us to choose the best (or the worst) of those moments.
