Fondo Editorial, 2021-05-26) Carbajal Valenzuela, Christian; Mendoza Neyra, YolandaWithin international investment arbitrations, international protection is usually denied to investments that have been made through acts of corruption as the majority of the investment arbitration tribunals do not assume jurisdiction or the claims are considered inadmissible. These decisions, inevitably and indirectly, lead to the exoneration of international responsibility of the defendant States due to the corruption of their public officials, even when these illicit acts are not configured unilaterally, existing, in most cases, shared responsibility between the investor and the State. By not sanctioning corruption, the current crisis in the investment dispute resolution system is aggravated, which, on the contrary, requires urgent and consensual solutions to guarantee a viable reform. Faced with this worrying scenario, this article examines mechanisms to achieve the confluence between International Investment Law, International Anti-Corruption Law and the international standards concerning the Responsibility of States for Internationally Wrongful Acts. We argue that if illicit behavior by public officials is found, depending on the circumstances of each case, the investment arbitration tribunals should rule on the international responsibility of the defendant States for failing to comply with the obligations arising from the International Anti-Corruption and Investment Treaties. Likewise, depending on the case, they must sanction investors and States, since both parties may be responsible for committing the illicit acts of corruption. Recognizing the limitations inherent to the powers of arbitral tribunals, it is possible to affirm that they cannot remain outside the international fight against corruption, as it has been agreed by the international community in the treaties that exist on this matter, being this the situation when the tribunals declare their lack of jurisdiction, avoiding to decide on the acts of corruption identified within the specific case.Ítem Texto completo enlazado La interpretación del término “juez nacional” por el Tribunal de Justicia de la Comunidad Andina(Pontificia Universidad Católica del Perú, 2019-04-11) Mendoza Neyra, Yolanda; Méndez Chang, Elvira VictoriaLa interpretación prejudicial es un proceso comunitario no contencioso. Sus efectos la convierte en la herramienta fundamental para garantizar la aplicación e interpretación uniforme del ordenamiento comunitario andino dentro del territorio de los Países Miembros de la Comunidad Andina. Mediante la interpretación prejudicial, también se asegura el correcto desarrollo del proceso de integración andino. El presente trabajo académico establece que el trabajo interpretativo del Tribunal de Justicia de la Comunidad Andina, órgano jurisdiccional de la Comunidad Andina, no utiliza las reglas de interpretación establecidas en la Convención de Viena sobre el Derecho de los Tratados de 1969 cuando analiza el término juez nacional, el mismo que se encuentra descrito en el Artículo 33° del Tratado de Creación del Tribunal de Justicia de la Comunidad Andina. El Tribunal de Justicia de la Comunidad Andina opta por una interpretación que amplía su significado y, en consecuencia, entiende que juez nacional también es un funcionario administrativo con función jurisdiccional y un árbitro.Ítem Texto completo enlazado La relevancia de los amicus curiae en los arbitrajes internacionales de inversión pos COVID-19 en materia de salud pública(Pontificia Universidad Católica del Perú, 2021-11-16) Carbajal Valenzuela, Christian; Mendoza Neyra, YolandaTo reduce the spread of the COVID-19 virus, States have been taking various measures to safeguard public health and other interests of their populations, actions that are not exempt from criticism, some will be considered necessary and reasonable, adopted in accordance with the state regulatory powers provided for by International Law. Others, on the other hand, because they might be considered arbitrary, disproportionate, and discriminatory, will be understood as violating International Investment Law and specific standards contained in Investment Treaties. Probably, in relation to many of these measures, the most discordant voices will be those of foreign investors, who may consider their interests severely harmed.Because of this situation of collision between legal regimes and interests protection of public health vs. protection of foreign investment, this article explores how amicus curiae, in times of emergency such as the one we are experiencing, will be of particular relevance to the issuance of reasonable decisions by arbitral tribunals in the forthcoming international investment arbitrations concerning public health. If the appropriate participation of amicus curiae in procedures with a clear public interest involved is consolidated, it will be an element that will contribute fundamentally to the implementation of transparency mechanisms in the investor-state dispute settlement system, which is absolutely necessary for its legitimacy.
