In this line of reasoning, the way in which the distinction between subjective and objective impartiality —identified with the “theory of appearances”—has been constructed is analyzed and, later, the relationship between impartiality and cognitive bias is determined. This is done with the aim of criticizing the theory of appearances and proposing the formulation of a standard in which three dimensions of the guarantee of impartiality are distinguished: subjective, objective-functional and objective-cognitive. Finally, the distinction between external and internal judicial independence is addressed, and its difference with impartiality is determined.Item Metadata only Garantismo y publicismo en el proceso civil: un enfoque analítico(Pontificia Universidad Católica del Perú, 2021-11-25) Cavani, Renzo; Castillo, ÁlvaroThis essay uses an analytic methodology in order to differentiate three approaches in the classical debate between activist (publicist) and adversarial (guarantee) models in the continental tradition of civil procedural law: the historical, philosophical and institutional approach. It is showed that each one of them has different premises of discussion and also allows to reach particular consequences. We defend a proposal to distinguish between the activist model and the adversarial model from a philosophical point of view by identifying the political theory premises that are in their foundations. In the activist model, the State’s function is to be a provider for the protection of fundamental rights and, therefore, the judicial process is conceived as an instrument of the jurisdiction in order to achieve its public goals. On the other hand, in the adversarial model, the State’s function assumes an abstentionist- type in order to preserve fundamental rights and hence, far from being and nstrument of judicial power, the judicial process is conceived as a citizen’s guarantee oriented to control that very power.Item Metadata only Legitimación en la ejecución, título ejecutivo y escisión societaria: una crítica a la “teoría de la afirmación”(Pontificia Universidad Católica del Perú, 2024-09-05) Valenzuela, Gabriella; Cavani, RenzoThis article aims to criticize the so-called “assertion theory” of civil procedure standing to sue, accepted by a significant part of the Peruvian jurisprudence, and consecrated by the Peruvian Civil Procedure Code. The paper seeks to show that this theory should be discarded since it has several conceptual problems, furthermore, it is not capable of giving an account of actual judicial practice when analyzing and deciding on the presence or absence of standing to sue. This becomes more noticeable in the field of judicial enforcement, and, to that extent, an example of corporate spin-off will be given to show that proving the existence of standing to sue concerning enforcement title can be complex, but that is essential for the judge to carry out this analysis.Item Metadata only ¿Qué es una resolución judicial? This analysis is made from an analyticdogmatic perspective, aiming to show that an adequate use of those concepts is decisive to solve practical problems, foremost in the field of the appeal.Item Metadata only Tecnología y oralidad en el proceso civil peruano(Pontificia Universidad Católica del Perú, 2020-08-20) Cavani, RenzoEste artículo inicia realizando un breve recuento histórico del uso de la tecnología y de las marchas y contramarchas de la oralidad en el proceso civil peruano, mostrando que el Poder Judicial peruano se encaminaba a implementar dos modelos diferentes: el proceso judicial electrónico y el modelo de la oralidad en la rama civil. Sin embargo, llegada la pandemia del COVID-19 y la adopción de medidas de distanciamiento y aislamiento por el gobierno central, el Consejo Ejecutivo del Poder Judicial decidió acelerar la implementación de ambos modelos en las diversas Cortes Superiores del país, pero condicionando el proceso electrónico a una previa migración a la oralidad. El presente artículo cuestiona esta decisión, ofreciendo una crítica al modelo de la oralidad tal como fue adoptado por el CEPJ y proponiendo que debería preferirse el proceso electrónico antes que la oralidad.
